ARTICLE 1: scope of the general conditions of sale.
The customer declares to have read and accepted these conditions of sale, at the latest at the time of the order.
Consequently, any contrary clauses or all general conditions of purchase emanating from the buyer are unenforceable against ARTEPY, except with the latter's prior written agreement.

ARTICLE 2: order
All orders must be subject to an order confirmation established by ARTEPY according to the instructions given by the customer.
The contract will be deemed formed upon receipt by the customer of this confirmation.
Any possible order modification must be accepted by ARTEPY and will be the subject of a new order confirmation.
ARTEPY reserves the right to accept or not an order cancellation for BOLON products, if this is accepted it will generate costs of 50% of the order amount.
For MURATTO products, cancellation or modification of the order will be refused.

ARTICLE 2 bis: storage costs
Any order not specifying a desired delivery date may be stored in our warehouses for a maximum period of 2 months. Beyond this, storage costs of €200 excluding tax per month and per pallet will be applied.

ARTICLE 3: delivery.
ARTEPY subcontracts the transport of its goods.
For all goods in stock in our warehouses, the goods are shipped within eight days of the establishment of the purchase order or receipt of the signed order confirmation.
In the event of an order for a volume or type of merchandise not present in stock, shipment will take place within 8 weeks following the establishment of the purchase order and acknowledgment of receipt of said order. In any case, the deadlines mentioned above are given for information purposes only, and any delay in delivery cannot result in the dissolution of the contract and the award of damages.
Any delay in shipping due to our manufacturer or in the event of force majeure cannot result in the dissolution of the contract or the award of damages. The goods are delivered to the place designated by the customer in the order form, unless there is a written order addressed to ARTEPY, and emanating from the customer or his agent and in particular the installer before departure of the goods from the place of dispatch.
Any complaint must be made within a maximum period of 7 days from delivery, otherwise it will be inadmissible.

ARTICLE 4: transportation.
Our products travel at the risk of the recipient, whatever the terms and conditions of transport. We decline all responsibility for damage, delay, or missing items and, therefore, do not accept to cover any compensation that may be claimed from us by our recipient. The latter has sole authority to assert his rights with the carriers and we urge him, where applicable, to make the necessary reservations upon receipt.

ARTICLE 5: deadlines.
Given for information purposes only. Under no circumstances can a delay give rise to penalties, order cancellations or refusal of the goods.

ARTICLE 6: complaints.
Only complaints made in writing, within eight days of receipt of the goods, will be taken into account. We will not, under any circumstances, accept the return of our materials if a defect, visible upon receipt, is reported to us after installation or cutting.
We do not guarantee uniformity of tones between pieces of the same quality and same color. Any return of goods must obtain our prior agreement.
In the event of replacement of defective goods, we do not cover the costs of removing and reinstalling the exchanged material. We decline all responsibility for articles manufactured by us whose use does not comply with our recommendations for use.

ARTICLE 7: reservation of ownership.
ARTEPY retains ownership of the goods sold until actual payment of the entire principal and accessory price.
Failure to pay a due date may result in the property being claimed.

ARTICLE 8: price.
All prices invoiced to the customer by ARTEPY are those in force on the day the order is registered and are expressed excluding tax. Prices are exclusive of any current or future taxes, duties or fees.
Also, the prices may be increased up to the amount of any current or future tax, duty or fee that ARTEPY may be required to collect or pay as part of the sale, without the purchaser having the possibility of canceling the command.
ARTEPY reserves the right to review its prices during the year in the event that it experiences significant price increases from its suppliers.

Article No. 8 Bis: Extended producer responsibility.
In application of article R 541-173 of the Environmental Code, we inform you that ARTEPY is part of a policy of taking charge of the collection, sorting, recovery and recycling of waste via the eco-organization VALOBAT and that as such our unique identifier number (IDU) referred to in article L 541-10-13 of said code is FR330602_04SXDP. In accordance with the provisions of article R 543-290-3 of the Environmental Code, the share of the unit cost that ARTEPY bears for the management of PMCB waste, as invoiced by the eco-organization to which ARTEPY is a member, is fully passed on to the professional buyer of the product without possibility of rebate.

ARTICLE 9: payment conditions.
Unless otherwise agreed by the company when ordering, payments are made in cash within 10 days maximum.
No discount for early payment.

ARTEPY reserves the right to require full payment for the order or payment guarantee with regard to customers presenting an excessive financial risk such as those who are not up to date with the payment of our previous invoices.

ARTICLE 10: late payment penalties.
If payment deadlines are stipulated, failure to pay on the due date automatically incurs default interest on the buyer, the rate of which is equal to 3 times the legal interest rate. The same will apply to late payment of the balance upon delivery.

ARTICLE 11: penal clause.
In the event of non-payment of an invoice on its due date, we reserve the right under the penalty clause to increase its amount by 15% with a minimum of €50, without prejudice to the late payment interest provided for in the article 10.

ARTICLE 12: guarantee.
In each delivery of its products, ARTEPY attaches a leaflet with a QR Code indicating installation and maintenance advice for BOLON products.
The principles of installation, use and cleaning as defined in the instructions are imperative. ARTEPY excludes its guarantee in the event of non-compliance with the requirements.

ARTICLE 13: competence.
Any dispute relating to this sale, even in the event of a warranty claim or multiple defendants, will fall under the exclusive jurisdiction of the Commercial Court, within whose jurisdiction the ARTEPY Company's headquarters are located.

ARTICLE 14: Others
Any order of BOLON products (cut and/or special tailor-made merchandise: Bolon By You, acoustic solution, Bolon Studio cut, personalized color) and any order of MURATTO products will not be returned or exchanged.
ARTEPY prohibits its customers from reselling its products on websites.
